NJ Legislators Introduce Bill to Classify Esports as Internet Gaming

New Jersey politicians and gaming regulators have taken moves in recent years to make the state a significant hub for the Esports business in the US. The legislation governing sports betting in New Jersey was changed in 2021 to include Esports competitions that have been authorized by the Division of Gaming Enforcement ("DGE") as a category of "sporting event" for which authorized sportsbooks may accept bets. The 2021 amendment made it possible for the state's brick-and-mortar, internet, and mobile sportsbooks to incorporate eSports wagering into their already-established sports betting businesses. Vie, an online/mobile sportsbook partner of Bally's Atlantic City, operates as an Esports-only online/mobile betting platform that received approval from the DGE earlier this year.

In order to further support the esports betting sector, New Jersey state assemblyman Ralph Caputo presented a bill in the New Jersey House of Representatives in June 2022. James Beach, a state senator from New Jersey, filed a similar version of the measure in the state Senate in September 2022. If passed, the measure would define "online gambling" to include "the placing of bets with a casino licensee on Esports" and recognize Esports as an "approved gambling game." The measure would also authorize the DGE to grant current Casino Licensees new Internet gambling licenses for "Esports." The conventional cap of five uniquely branded online/mobile gambling platforms per Casino Licensee would not apply to these platforms. It is currently unknown if the online/mobile products made possible by such provision would be confined to Esports betting (like the Vie platform) or would also include skill-based games with Esports influences where players may compete directly against the house and/or other players.
